Recent Notes From Training Regarding ICE

  • ICE will often pose as police and say “this is the police,” rather than “this is ICE”
  • VOLUNTEERS SHOULD ALWAYS GET STAFF IF POLICE OR ICE ARE AT THE DOOR.
  • Shelters are considered “sensitive areas,” meaning that ICE should not go there unless they have to and have permission from ICE directors; This Is Not Guaranteed
  • ICE is not permitted in our shelter without a Judicial warrant signed by a judge. ICE agents rarely ever have judicial warrants. ICE will likely present an “administrative warrant” signed by ICE officials. Do not accept this as a warrant. Shelters are not required to allow officers in with only an administrative warrant and we should refuse. 
    • The safest approach if ICE comes to shelter is to either ask them to hold the warrant up to the camera, or quickly step outside and shut the door. Look for the judge’s signature.
  • People are required to give police your name and address in Indiana; Individuals are not required to speak to ICE at all. This is an important point to remember – ICE are not the police. Let clients know that if stopped, they should ask “am I free to go?” If the answer is no, ask “am I being detained.” If the answer is yes, request a lawyer and they should then say nothing further.
